I have a friend that is currently being threatened to be sued because her 2 year old son bit another young kid at McDonalds. This other family "claims" that their kid will probably need surgery for how hard she was bitten, yet the parents of the other kid did not say anything to my friend at the time of the incident that thier kid had been bitten. What should she do?... Her son isn't old enough to understand that what he may have done actually hurt. Plus, this other family cant even keep a solid story every time the have contacted my friend. The bill fluctuates higher and higher and they are sounding very money greedy...I/They need some advice....

The best thing for them to do is hire a lawyer. If their demands are getting higher and higher, it's only going to get worse.

Was there a police report filed? If not, I suggest they call and file one. Even if it is late, at least they will have the incident reported. That helps in court. Also, they need to keep notes and any recordings left on voicemails from them.

Ugh, how horrible that they are using kids-play to get money.

Edited to add-like Rocker said, the parents of the child that bit the other child should cover the medical expenses, but if they start asking for stuff that isn't an actual bills-that is when you need the lawyer. Punitive damages, pain and suffering and whatnot will be taken care of by the judge-BUT it's best that they have counsel to mediate the expenses.

It's too bad that people threaten to sue over everything. I do believe that the parents of the child that did the biting should take responsibility for the medical bill. (If indeed their child did cause that much damage.) Did they offer that?

What is this world coming to? Where could a kid be bitten that a two year old bite could cause enough damage to need surgery - in the eyeball?

It seems like our country is filled with victims. It never used to be that way. Sadly, all the more reason to keep your kids cooped up at home in front of the TV, away from people, because you never know when something bad will happen and you'll get sued. That's why we have a high-dollar umbrella liability insurance policy for our household.

I have a friend who is a pretty successful defense attorney in North Carolina. He refuses to coach his kid's athletic teams, like t-ball and soccer, or to do much mentoring in his kid's school in fear of being accused of something...and he's advised me to not participate in those activities as well. He's defended so many people accused of one thing or another related to child sporting or academic activities that it would give most folks a chill.
Here's an example of an absurd lawsuit (but not related to child injuries) - He had one client who was taken to court because a "victim" was hunting on his property without permission. As he was climbing over some rocks, he stumbled and shot himself in the foot with his shotgun. He took the property owner to court(amazingly it went that far) because the "No Hunting - No Trespassing" signs weren't in reasonable sight around the perimeter of the property and that the property owner didn't adequately maintain his property, but he lost the case....not before my buddy's client spent thousands for his defense. Unbelievable.

This sounds fishy to me. In my experience, if a toddler is bitten (or falls, etc.) it is usually immediately obvious that something has happened. One of the kids, maybe both, would have been crying or yelled. I wouldn't offer to pay a single cent until I had checked with the police to see if a report had been filed. If so, I would try to find an attorney who specializes in this type of thing and take his advice. I would not take any more calls from the parents.

I would tell them to do what they needed to do. In other words, Sue me. I would then file a counter suit to cover any expenses I would incure. My guess is that it would end right there. If not then at least you would have the court's decision.

I'm curious as to whether McDonald's has been threatened with a suit also, as it happened on their property. If they have attorney's on it, they would in a sense also be working to the benefit of the family whose child bit the other child. Maybe the "victims" are only willing to take on the little guy if they are out to make a buck.

Almost identical thing happened to our son. Recieved a note on his vehicle claiming he had hit another vehicle, and the note even stated it knew who is parents were. (us)
The note said if he did not pay his parents would be contacted. The damage to his truck had been documented last year with photos (hasn't changed) when another vehicle backed into his vehicle.
In any case, he just recieved a notice from LIBERTY MUTUAL INSURANCE demanding 6K. No joke. The demand letter does NOT state "when" "where"or even "who"
this was suppose to have happened to. Swear to gosh it just demands 6K.

I'd get a LAWYER and SUE the living heck out of these people. I'd also STATE THEIR NAMES ON THIS BLOG! Beware neighbors, business owners, etc.

Good Luck. I'd find a really mean, nasty, greedy, sob lawyer and give them a little of their own medicine. Get em! (Funny, they'll go on this blog and accuse you of being "sue happy.)

Report this to the POLICE Department and demand a report be made for "extortion."

...just as a pet owner is for their animal!

Both scenarios require that there is the necessity for undivided supervision and training.

Oh, c'mon. Are you serious regarding this particular situation? If anything, this is another reminder that this country is in serious need of Tort Reform.
